Potential Penalties

This section states general penalty ranges under Colorado state law. Be advised that some offenses have specific penalties not stated here. Also, you may face other penalties such as restitution, community service, classes, etc. You may be required to register on the sex offender registry. In addition, some offenses cause you to lose your driver's license. You may face penalties other than those stated here. You may also have to pay a surcharge. Seek legal advice for your specific situation.

General penalties for traffic offenses are as follows:

  • Class one misdemeanor traffic offense: Minimum sentence is ten days imprisonment or a $100 fine or both; Maximum sentence is one year imprisonment or a $1000 fine or both.
  • Class two misdemeanor traffic offense: Minimum sentence is ten days imprisonment or a $10 fine, or both; Maximum sentence is ninety days imprisonment or a $300 fine or both.

General penalties for misdemeanors under Colorado state law are as follows:

  • Class one misdemeanor: Minimum sentence is six months imprisonment or a $500 fine or both; Maximum sentence is eighteen months imprisonment or a $5,000 fine or both.
  • Class two misdemeanor: Minimum sentence is three months imprisonment or a $250 fine, or both; Maximum sentence is twelve months imprisonment or a $1,000 fine or both.
  • Class three misdemeanor: Minimum sentence is a $50 fine; Maximum sentence is six months imprisonment or a $750 fine or both.

General penalties for petty offenses under Colorado state law are as follows:

  • Class one petty offense: Fine of not more than $500, or imprisonment for not more than six months, or both, plus restitution if appropriate.
  • Class two petty offense: A fine a specified in the statute defining the offense, plus restitution if appropriate.
